Helping Ensure Safety Through Mental Health Intervention
A Mental Inquest Warrant (MIW) is a legal process that allows for the temporary hospitalization of someone experiencing a severe mental health crisis. This action aims to stabilize the individual’s condition when they pose a threat to themselves, their family, or others, and when hospitalization is the least restrictive way to provide treatment.
You may file an MIW for someone who meets the following criteria:
- The person is suffering from a mental illness.
- They present a danger or threat to themselves, their family, or others due to their mental illness.
- They can reasonably benefit from treatment.
- Hospitalization is the least restrictive treatment option available.
It is important to note that an MIW cannot be used for someone whose sole issue is alcohol or drug abuse, or for someone who is developmentally disabled and cannot benefit from hospitalization.
To begin the process of filing an MIW, please visit the Clay County Attorney’s Office during regular office hours. In emergency situations outside these hours, contact local law enforcement or dial 911 for immediate assistance.
